  1. 1. Purpose<\/strong><\/li><\/ol>

    Erivan Impex has developed a ridesharing platform, accessible through a website at www.go2to.eu<\/a> www.Go2To.de or as a mobile application, which aims to:
    (i) connect drivers traveling to a specific destination with passengers going in the same direction, allowing them to share the journey and, consequently, the associated costs; and
    (ii) facilitate the booking of bus tickets operated by transportation companies authorized by Go2To (hereinafter referred to as \u201cthe Platform\u201d).<\/p>

    These General Terms and Conditions are intended to govern the terms of access to and use of the Platform. Please read them carefully. You understand and acknowledge that Go2To is not a party to any agreement, contract, or legal relationship of any kind that may be entered into between members of its Platform or with a transportation company.<\/p>

    By clicking on \u201cSign in with Facebook\u201d or \u201cRegister with email address,\u201d you confirm that you have read and fully accepted these General Terms of Use.<\/p>

    1. 2. Definitions<\/strong><\/li><\/ol>

      For the purposes of this document:
      \u2022 \u2022\t\u201cGTC\u201d means these General Terms and Conditions;
      \n\u2022\t\u201cListing\u201d means a travel announcement posted by a driver on the Platform;
      \n\u2022\t\u201cOrder\u201d means the process by which the customer books services through Go2To Bus, regardless of the means used, except for tickets purchased directly from a point of sale, and which entails the passenger\u2019s obligation (or that of an authorized agent) to pay the price for the corresponding services;
      \n\u2022\t\u201cGo2To\u201d has the meaning assigned in Article 1 above;
      \n\u2022\t\u201cBooking\u201d has the meaning set out in Article 4.2.1 below;
      \n\n\u2022\t\u201cPrice\u201d means, for a given bus trip, the total amount including all taxes, fees, and costs related to the relevant services, paid by the customer on the Platform at the time of confirming the order for a seat on a specific bus trip;
      \n\u2022\t\u201cSeat\u201d means the seat reserved by a passenger in the driver\u2019s vehicle or in the vehicle used by the transportation company;
      \n\u2022\t\u201cTicket\u201d means the nominal transport document issued to the consumer after booking a bus trip, serving as proof of the existence of the transport contract between the passenger and the transportation company, which is governed by the company\u2019s general conditions of sale, without prejudice to any special conditions agreed between the passenger and the company and indicated on the ticket;
      \n\u2022\t\u201cTransportation Services\u201d means the transportation services subscribed to by the passenger and provided by the transportation company;
      \n\u2022\t\u201cPoint of Sale\u201d means the physical counters and terminals listed on the website where tickets are available for purchase;
      \n\u2022\t\u201cConditions of Sale\u201d means the general conditions of sale of the respective transportation company, depending on the trip selected by the customer, as well as any special conditions available on the website, which the customer confirms having read prior to placing the order;
      \n\u2022\t\u201cWebsite\u201d means the site accessible at www.go2to.eu.<\/strong> \u2022\t\u201cGTC\u201d means these General Terms and Conditions;
      \u2022 \u201eHirdet\u00e9s\u201d<\/strong> eine von einem Fahrer auf der Plattform ver\u00f6ffentlichte Fahrtanzeige;
      \u2022 \u201eBestellung\u201c<\/strong> den Vorgang, durch den der Kunde seine Dienstleistungen \u00fcber Go2To Bus bucht, unabh\u00e4ngig von den verwendeten Mitteln, mit Ausnahme des direkten Ticketkaufs an Verkaufsstellen, und der die Verpflichtung des Fahrgastes oder seines Vertreters beinhaltet, den Preis f\u00fcr die entsprechenden Dienstleistungen zu zahlen;

      \u2022 \u201eBusfahrt\u201c<\/strong> die Fahrt, die Gegenstand einer Busanzeige ist, f\u00fcr die der Busbetreiber Pl\u00e4tze in seinen Fahrzeugen gegen Entgelt anbietet;
      \u2022 \u201eBusanzeige\u201c<\/strong> ein vom Busbetreiber auf der Plattform ver\u00f6ffentlichtes Angebot f\u00fcr eine Busreise;
      \u2022 \u201eDienstleistungen\u201c<\/strong> alle von Go2To \u00fcber die Plattform angebotenen Leistungen;
      \u2022 \u201eFacebook-Konto\u201c<\/strong> die Bedeutung gem\u00e4\u00df Artikel 3.2;
      \u2022 \u201eFahrer\u201c<\/strong> das Mitglied, das die Plattform nutzt, um eine andere Person im Austausch f\u00fcr eine Kostenbeteiligung zu transportieren, f\u00fcr eine bestimmte Fahrt und zu einem ausschlie\u00dflich vom Fahrer festgelegten Zeitpunkt;

      \u2022 \u201eKunde\u201c<\/strong> jede nat\u00fcrliche Person (Mitglied oder nicht), die f\u00fcr sich oder im Namen einer anderen Person (Fahrgast) ein Busticket auf der Plattform erwirbt;
      \u2022 \u201eKonto\u201c<\/strong> das Konto, das erstellt werden muss, um Mitglied zu werden und Zugang zu bestimmten Diensten zu erhalten;
      \u2022 \u201eKostenbeteiligung\u201c<\/strong> den Geldbetrag, den der Fahrer f\u00fcr eine bestimmte gemeinsame Fahrt verlangt und den der Fahrgast akzeptiert;
      \u2022 \u201eReisesegment\u201c<\/strong> die Bedeutung gem\u00e4\u00df Artikel 4.1;
      \u2022 \u201eRidesharing-Anzeige\u201c<\/strong> eine vom Fahrer ver\u00f6ffentlichte Fahrtanzeige;
      \u2022 \u201eMitglied\u201c<\/strong> jede Person, die ein Konto auf der Plattform erstellt hat;
      \u2022 \u201eMitgliederinhalt\u201c<\/strong> die Bedeutung gem\u00e4\u00df Artikel 11.2;
      \u2022 \u201eFahrgast\u201c<\/strong> das Mitglied, das das Angebot des Fahrers annimmt oder die Person, f\u00fcr die ein Mitglied einen Platz reserviert hat;
      \u2022 \u201ePlattform\u201c<\/strong> die Bedeutung gem\u00e4\u00df Artikel 1;
      \u2022 \u201ePreis\u201c<\/strong> den Gesamtpreis einer bestimmten Busfahrt einschlie\u00dflich aller Steuern, Geb\u00fchren und Kosten f\u00fcr relevante Dienstleistungen, den der Kunde bei der Bestellbest\u00e4tigung bezahlt;
      \u2022 \u201ePlatz\u201c<\/strong> der vom Fahrgast reservierte Sitzplatz im Fahrzeug des Fahrers oder im Fahrzeug des Busunternehmens;
      \u2022 \u201eTicket\u201c<\/strong> der ausgestellte Transportnachweis nach der Buchung einer Busfahrt, der den Transportvertrag zwischen Fahrgast und Busunternehmen best\u00e4tigt;
      \u2022 \u201eTransportleistungen\u201c<\/strong> die Leistungen, die dem Fahrgast vom Busunternehmen erbracht werden;
      \u2022 \u201eVerkaufsstellen\u201c<\/strong> die auf der Website aufgef\u00fchrten physischen Schalter und Terminals, an denen Tickets verkauft werden;
      \u2022 \u201eVerkaufsbedingungen\u201c<\/strong> die allgemeinen Verkaufsbedingungen des jeweiligen Busunternehmens, die f\u00fcr die vom Kunden ausgew\u00e4hlte Fahrt gelten, sowie die besonderen Bedingungen auf der Website, die der Kunde vor der Bestellung best\u00e4tigt hat;
      \u2022 \u201eWebsite\u201c<\/strong> die unter       www.go2to.eu<\/a> erreichbare Seite.<\/p>

      1. Registration on the Platform and Account Creation<\/strong><\/li><\/ol>

        3.1. Conditions for Registration on the Platform<\/strong><\/p>

        The Platform may be used by individuals who are at least 18 years of age. Registration by minors is strictly prohibited.
        By accessing, using, or registering on the Platform, you declare and warrant that you are at least 18 years old.<\/p>

        3.2. Account Creation<\/strong><\/p>

        The Platform allows members to post and view ridesharing listings and to interact with each other in order to book a seat.
        You may view listings without registering on the Platform; however, you cannot post a listing or book a seat without first creating an account and becoming a member.<\/p>

        To create your account, you may either:
        (i) fill in all mandatory fields in the registration form; or
        (ii) connect through your Facebook account via our Platform (hereinafter referred to as the \u201cFacebook Account\u201d).<\/p>

        By using this function, you agree that Go2To may access your Facebook account, post information on the Platform, and store certain data from that account.
        You may remove the link between your Go2To account and your Facebook account at any time in the \u201cVerifications\u201d section of your profile.<\/p>

        If you wish to learn more about how data retrieved from your Facebook account is used, please refer to our Privacy Policy and Facebook\u2019s Privacy Policy.<\/p>

        To register on the Platform, you must have read and accepted these General Terms and Conditions (GTC) as well as the Privacy Policy.
        When creating your account, regardless of the chosen method, you undertake to provide accurate and truthful information and to keep it up to date through your profile or by notifying Go2To, to ensure that it remains relevant and accurate throughout the contractual relationship with Go2To.<\/p>

        If you register via email, you agree to maintain the confidentiality of the password you chose when creating the account and not to disclose it to anyone.
        If you lose your password or it becomes disclosed, you agree to inform Go2To without delay.<\/p>

        You are solely responsible for any use of your account by third parties, except in cases where you have expressly informed Go2To of the loss, fraudulent use by third parties, or disclosure of your password.<\/p>

        You also agree not to create or use any other accounts than the one originally created, whether under your own identity or that of another person.<\/p>

        3.3 Verifizierung<\/strong><\/p>

        Go2To may implement, for transparency purposes, trust enhancement, or fraud prevention and detection, a system for verifying certain information provided in your profile.\nThis applies in particular when you enter your phone number or provide an identity document.\n\nYou acknowledge and agree that any reference on the Platform or within the services to \u201cverified\u201d information, or similar terms, merely indicates that a member has successfully completed the existing verification process on the Platform or within the services, with the purpose of providing additional information about the person you are about to travel with.\nGo2To cannot guarantee the accuracy, reliability, or validity of the information subject to the verification process.<\/p>

        1. Use of the Services<\/strong><\/li><\/ol>

          4.1. Posting Listings<\/strong><\/p>

          As a member, you may create and publish ridesharing listings on the Platform, provided that you meet the following requirements and complete the necessary details regarding the trip you intend to make (dates\/times, departure and arrival points, number of seats offered, available options, cost contribution amount, etc.).<\/p>

          When posting a listing, you may indicate intermediate cities where you are willing to stop to pick up or drop off passengers. The travel sections between these intermediate cities, or between one of them and the departure or final destination point, constitute \u201cstops.\u201d<\/p>

          (i) you hold a valid driver\u2019s license;
          \n(ii) you post listings only for vehicles that you own or use with the express permission of the owner and for which you are authorized to use for ridesharing purposes;
          \n(iii) you are and remain the main driver of the vehicle mentioned in the listing;\n(iv) the vehicle has valid liability insurance coverage;
          \n(v) you have no medical conditions that would prevent you from driving;
          \n(vi) the vehicle used is a passenger car with four wheels and a maximum of seven seats, except for those not requiring a driving license;
          \n(vii) you do not publish another listing for the same trip on the Platform;
          \n(viii) you do not offer more seats than the vehicle has;
          \n(ix) all offered seats are equipped with seat belts, even if the vehicle is type-approved without them;
          \n(x) you use a vehicle in perfect working condition, compliant with legal standards, including valid technical inspection;
          \n(xi) you act as a private individual and not as a professional.<\/p>

          You are solely responsible for the content of the listing you publish. Therefore, you declare that all provided information is accurate and undertake to perform the trip as described.
          Your listing will be published on the Platform and visible to all users, including unregistered ones. Go2To reserves the right to refuse or remove any listing that does not comply with these Terms and Conditions or that may negatively affect its image.<\/p>

          4.2. Seat Reservation<\/strong><\/p>

          Go2To provides an online seat reservation system (\u201cBooking\u201d) for trips available on the Platform.\nBooking methods vary depending on the type of trip planned.\n\nThe Platform offers a search function based on criteria (origin, destination, dates, number of passengers, etc.). Certain additional features are available to users logged into their accounts.<\/p>

          4.2.1. Ridesharing<\/strong><\/p>

          If a passenger is interested in an offer with active booking, they may send an online booking request.
          . This request is either:
          (i) automatically accepted (if the driver has chosen this option) or
          (ii) manually approved by the driver.<\/p>

          The passenger pays the cost contribution online at the time of booking. After payment confirmation and, if applicable, driver validation, the passenger receives a booking confirmation.<\/p>

          If you are a driver and have chosen manual validation of requests, you must respond within the time frame indicated by the passenger; otherwise, the request automatically expires, and the paid amount is refunded.<\/p>

          Once the booking is confirmed, you are solely responsible for the fulfillment of the agreement made with the other member.<\/p>

          4.2.2. Bus Travel<\/strong><\/p>

          For bus trips, Go2To enables the booking of tickets for routes available on the Platform.
          The transportation services are subject to the terms and conditions of sale of the selected bus operator, which must be accepted before placing the order. Go2To does not provide transportation services and is not a contractual party; the bus operator is solely responsible.
          Go2To warns that certain trips may be canceled due to seasonal, weather-related, or force majeure reasons.<\/p>

          4.2.3. Personal Nature of Booking and Use on Behalf of Third Parties<\/strong><\/p>

          All use of the services is personal. Both the driver and the passenger must correspond to the identity communicated to the Platform and, where applicable, to other participants.
          Go2To allows the booking of one or more seats on behalf of a third party.<\/p>

          Booking a seat for a minor under the age of 13 traveling alone is strictly prohibited.
          For a minor over 13 years old, prior consent of the driver and a written authorization signed by the legal representatives must be obtained.
          It is also prohibited to publish a travel listing on behalf of another driver.<\/p>

          For bus trips, the specific conditions of the respective operator must be consulted.<\/p>

          4.2.4. Delivery and Parcel Service<\/strong><\/p>

          The sender and the recipient are solely responsible for the proper use and performance of the delivery service provided through Go2To, according to the description and agreement between the parties (including photos).
          Go2To assumes no liability and cannot be held responsible for such deliveries.<\/p>

          4.3. Rating System<\/strong><\/p>

          4.3.1. Functionality<\/strong><\/p>

          Go2To encourages members to leave a review about the driver (if you are a passenger) or about the passenger (if you are a driver) after a completed or planned trip.
          You are not entitled to rate other passengers or members with whom you have not actually traveled.
          Your review and the other member\u2019s review become visible immediately.<\/p>

          4.3.2. Moderation<\/strong><\/p>

          Go2To reserves the right not to publish or to delete opinions, comments, or responses that violate these Terms and Conditions.<\/p>

          4.3.3. Limitation<\/strong><\/p>

          Go2To may suspend your account, restrict access, or terminate the contract if:
          (i) you have received at least three reviews, and
          (ii) the average rating is equal to or below 3.<\/p>

          1. Financial Conditions<\/strong><\/li><\/ol>

            Access to the platform, registration, searching, browsing, and posting ads are free of charge.
            However, seat reservations are subject to payment, under the conditions described below.<\/p>

            5.1. Cost Contribution and Price<\/strong><\/p>

            5.1.1. Ridesharing trips<\/strong><\/p>

            In the context of a shared trip, the amount of the cost contribution is determined by you, as the driver, under your sole responsibility.
            It is strictly forbidden to make a profit from the use of the platform.
            Therefore, you agree to limit the contribution requested from passengers only to cover the actual costs of the trip.
            Otherwise, you assume the risk of the transaction being reclassified as a commercial activity.<\/p>

            5.1.2. Bus trips<\/strong><\/p>

            For bus trips, the price per seat is freely determined by the transport company.
            The customer must consult the terms and conditions of the respective company for details regarding the ordering and payment methods for the ticket.<\/p>

            5.2. Rounding<\/strong><\/p>

            You agree that Go2To may, at its sole discretion, round up or down the cost contribution or service fees.<\/p>

            5.3. Payment and Refund Methods<\/strong><\/p>

            As a company, you have the following option to receive the contribution payment from passengers:
            \u2022 Online payment<\/strong> (see 5.3.1)<\/p>

            As a driver, you have the following option to receive the contribution payment from passengers:
            \u2022 Cash payment (see 5.3.3)<\/strong> (siehe 5.3.3)<\/p>

            5.3.1. Online payment \/ Collection mandate<\/strong><\/p>

            In the case of online payment, you accept the rules and conditions provided by the online payment processor Stripe.
            You agree to provide, upon request from Go2To or the competent authorities (e.g., for anti\u2013money laundering purposes), all required identity or address documents.
            In the absence of a response, Go2To may block the funds, suspend the account, or terminate the contract.<\/p>

            5.3.2. Online payment of the contribution to the company<\/strong><\/p>

            After the trip is completed, the company receives a credited amount in its account via Stripe, representing the price charged for a seat.
            The transfer is made automatically in accordance with Stripe\u2019s payment conditions.<\/p>

            5.3.3. Cash payment<\/strong><\/p>

            The driver may collect the amount in cash; in this situation, the passenger must pay the contribution no later than upon arrival, directly in the vehicle.
            The driver is not allowed to request advance, partial, or full payment before the start of the trip.
            No commission is charged for cash payments.<\/p>

            5.4. Payment of the Price<\/strong><\/p>

            Payment for any order made through the platform shall only be made using the methods authorized by Go2To.
            The available payment method is Stripe. In order to book trips, you must have a valid Stripe user account.<\/p>

            The order is not confirmed until full and valid payment has been made.
            In the event of a failed, incomplete, or canceled payment due to the client\u2019s fault, the order is automatically canceled.<\/p>

            The order confirmation is sent by e-mail, and the client must ensure that the message does not reach the \u201cSpam\u201d folder.
            The confirmation is final \u2014 any subsequent modification is treated as a new order or cancellation, according to the applicable terms.<\/p>

            The client is responsible for the accuracy of the data entered, except where Go2To demonstrably failed to protect or store it properly.<\/p>

            5.5. Subscriptions (ABO)<\/strong><\/p>

            Subscriptions may be subject to a fee for commercial providers, according to the details below.<\/p>

            5.5.1. Welcome Subscription<\/strong><\/p>

            Free for all users.
            For commissions, see 5.5.4.<\/p>

            5.5.2. Standard-Abonnement<\/strong><\/p>

            Free for all users.
            For commissions, see 5.5.4.<\/p>

            5.5.3. Basic & Premium Subscriptions<\/strong><\/p>

            The first 6 months are free of charge, after which they become paid if the use continues.<\/p>

            5.5.4. Commissions<\/strong><\/p>

            As compensation for the use of the platform, Go2To may charge the following additional fees:
            \u2022 Go2To may withhold a sales and usage commission of 3\u201310% of the total transaction amount.
            \u2022 A Stripe service fee of approximately 3.5% of the total transaction amount applies to commercial users. For details, please refer to Stripe\u2019s policy.<\/p>

            Thus, a minimum commission of 7.5% is automatically added to all entered prices.
            This surcharge covers the intermediation commission of our platform and is calculated automatically.
            The user is informed in advance regarding these fees.<\/p>

            The exact calculation methods may be published separately by Go2To.
            The company reserves the right to modify at any time the formulas for calculating commissions or monthly subscription fees.
            These modifications do not affect services already accepted prior to their entry into force.<\/p>

            For international trips, the calculation methods for commissions and VAT may vary depending on the departure point and\/or destination.<\/p>

            1. Non-commercial and Non-business Purpose of the Services and the Platform<\/strong><\/li><\/ol>

              You agree to use the services and the platform exclusively for non-commercial and non-business purposes, to connect with individuals who wish to share a trip with you or book a seat on a bus trip.<\/p>

              Regarding the ridesharing service, you acknowledge that the consumer rights provided under European Union consumer protection law do not apply to your relationship with other members.<\/p>

              As a driver, you agree not to request a cost contribution higher than the actual expenses you incur, which could generate a profit, provided that, within cost sharing, you also bear your own portion of the trip costs.
              You are solely responsible for calculating the actual costs of the trip and verifying that the amount requested from passengers does not exceed the real expenses (excluding your own share), especially considering applicable tax rates.<\/p>

              Go2To reserves the right to suspend your account if you use a chauffeur-driven vehicle, a commercial vehicle, a taxi, or a company car and obtain profit through the platform.
              You agree to provide Go2To, upon simple request, a copy of the vehicle registration and\/or any document proving that you are authorized to use the vehicle on the platform and that you are not making a profit from it.<\/p>

              Go2To also reserves the right to suspend your account, restrict access to services, or terminate these Terms and Conditions if the activities you conduct on the platform \u2014 by their nature, frequency, or number of trips, as well as the amounts charged to passengers \u2014 lead to a situation of profit or reasonably cause Go2To to suspect that you are profiting from the platform.<\/p>

              1. Cancellation Conditions<\/strong><\/li><\/ol>

                7.1. Refund Conditions in Case of Cancellation<\/strong><\/p>

                7.1.1. Individual (private person)<\/strong><\/p>

                Trips where the driver has chosen to receive the cost contribution in cash, in the vehicle, may be canceled at any time before departure, either by the driver or by the passenger.\nIn this case, the passenger does not pay, and the driver does not receive any contribution.<\/p>

                7.1.2. Company<\/strong><\/p>

                Only trips offered by companies where payment is made online are subject to these cancellation conditions; Go2To provides no guarantee in the event of cancellation, regardless of the reason.
                For bus trips, the cancellation conditions are those established by the respective transport company\u2019s terms and conditions of sale.<\/p>

                Cancellation of a seat in a ridesharing trip by the company or passenger, after booking confirmation, is subject to the following provisions:<\/p>

                • \u2022 In case of cancellation by the company, the passenger is refunded the full amount paid for the ticket<\/strong> This applies in particular when the driver cancels the trip.<\/li>
                • \u2022 In case of cancellation by the passenger:<\/strong>
                  If the cancellation is made by the passenger, the amount paid is non-refundable after the transaction has been completed.\nThe passenger is obliged to carefully review the booking details before confirming, in order to avoid errors that may lead to the loss of the paid amount.<\/li><\/ul>

                  If a cancellation occurs before departure and is due to the passenger, the canceled seats are automatically made available to other passengers who may book them online, under the same terms and conditions provided in these Terms and Conditions.<\/p>

                  7.2. Right of Withdrawal<\/strong><\/p>

                  By accepting these Terms and Conditions, you expressly agree that the agreement between you and Go2To \u2014 consisting of your connection with another member \u2014 shall be executed before the expiry of the statutory withdrawal period from the date of booking confirmation, and you expressly waive your right of withdrawal pursuant to Article \u00a7356(4) of the German Civil Code (BGB).<\/p>

                  1. User and Member Conduct on the Platform<\/strong><\/li><\/ol>

                    8.1. Obligations of All Platform Users<\/strong><\/p>

                    You acknowledge that you are solely responsible for complying with all laws, regulations, and obligations applicable to your use of the platform.<\/p>

                    You also agree that, while using the platform and during trips, you will:<\/p>

                    (i) not use the platform for professional, commercial, or profit-making purposes unless you are a transport company;
                    (ii) not provide Go2To (especially when creating or updating your account) or other members with false, misleading, malicious, or fraudulent information;
                    (iii) keine Inhalte zu ver\u00f6ffentlichen oder sich in irgendeiner Weise auf der Plattform verleumderisch, beleidigend, obsz\u00f6n, pornografisch, vulg\u00e4r, aggressiv, unangemessen, gewaltt\u00e4tig, bedrohlich, bel\u00e4stigend, rassistisch oder fremdenfeindlich zu verhalten oder Inhalte mit sexuellen Konnotationen, Gewaltaufrufen, Diskriminierung oder Hass, F\u00f6rderung illegaler Aktivit\u00e4ten oder Substanzen oder allgemein Inhalte zu verbreiten, die dem Zweck der Plattform zuwiderlaufen, die Rechte von Go2To oder Dritten verletzen oder gegen die guten Sitten versto\u00dfen;
                    (iv) not infringe upon the rights or image of Go2To, particularly its intellectual property rights;
                    (v) not open more than one account on the platform and not create an account on behalf of another person;
                    (vi) not attempt to bypass the platform\u2019s online booking system, especially by trying to send your contact details to another member or a transport company in order to make a booking outside the platform;
                    (vii) not contact other members, particularly through the platform, for purposes other than arranging a shared trip;
                    (viii) not accept or make payments outside the platform, except where expressly permitted under these Terms and Conditions;
                    (ix) comply with these Terms and Conditions and the Privacy Policy;
                    (x) obtain Go2To\u2019s permission before making audio or video recordings for commercial purposes during a trip.<\/p>

                    8.2. Obligations of Drivers<\/strong><\/p>

                    If you use the platform as a driver, you further agree to:<\/p>

                    (i) comply with all laws, regulations, and codes applicable to driving and vehicle use, including holding valid civil liability insurance and a valid driver\u2019s license at the time of the trip;
                    (ii) verify that your insurance covers ridesharing and that passengers are considered third parties, and therefore are covered by your insurance throughout the trip;
                    (iii) not take risks while driving and not consume any substances that may impair your attention or ability to drive safely;
                    (iv) post ridesharing ads only for genuine, planned trips;
                    (v) carry out the trip as described in the ad (including whether or not you use highways) and respect the times and locations agreed with other members (meeting point and destination);
                    (vi) not transport more passengers than the number of seats specified in the ad;
                    (vii) use a vehicle that is in excellent technical condition and compliant with current legislation, including a valid technical inspection;
                    (viii) provide Go2To or any passenger who requests it with your driver\u2019s license, vehicle registration, insurance, technical inspection proof, and any document demonstrating your right to use the vehicle on the platform;
                    (ix) immediately inform passengers in case of delay or change in schedule or route;
                    (x) carry identity documents and those required for border crossing in the case of international trips, and present them to passengers or authorities upon request;
                    (xi) wait for passengers at least 15 minutes after the agreed time at the meeting point;
                    (xii) not post trip ads for vehicles that you do not own or do not have the right to use for ridesharing purposes;
                    (xiii) ensure that passengers can contact you through chat on your profile;
                    (xiv) not obtain profit from using the platform;
                    (xv) not have any medical conditions that contraindicate driving;
                    (xvi) behave responsibly and appropriately during the trip, in keeping with the spirit of ridesharing.<\/p>

                    8.3. Obligations of Passengers<\/strong><\/p>

                    8.3.1. For Ridesharing Trips<\/strong><\/p>

                    If you use the platform as a passenger, you agree to:<\/p>

                    (i) behave appropriately during the trip, without disturbing the driver\u2019s concentration or the peace of other passengers;
                    (ii) respect the vehicle and keep it clean;
                    (iii) immediately inform the driver in case of delay;
                    (iv) pay the driver the agreed cost contribution;
                    (v) wait for the driver at the meeting point at the agreed time or up to 15 minutes afterward;
                    (vi) provide Go2To or any driver who requests it with an identity document;
                    (vii) not carry objects, goods, substances, or animals that could interfere with driving or are prohibited by law;
                    (viii) die f\u00fcr internationale Fahrten erforderlichen Ausweis- und Grenzdokumente bereitzuhalten und auf Verlangen dem Fahrer oder den Beh\u00f6rden vorzulegen;
                    (ix) ensure that you can be contacted by the driver through chat, including at the meeting point.<\/p>

                    If you make a booking on behalf of one or more third parties, you guarantee their compliance with these Terms and Conditions.
                    Go2To reserves the right to suspend your account, restrict service access, or terminate these Terms and Conditions in the event of a breach by any person for whom you made a booking.<\/p>

                    8.3.2. For Bus Trips<\/strong><\/p>

                    For bus trips, passengers agree to comply with the terms and conditions of sale of the respective transport company.<\/p>

                    1. Account Suspension, Access Restriction, and Termination<\/strong><\/li><\/ol>

                      You may terminate your contractual relationship with Go2To at any time, free of charge and without cause, by selecting the \u201cClose my account\u201d<\/strong> option on your profile page.<\/p>

                      In the event of
                      (i) a breach of these Terms and Conditions, including but not limited to your obligations as a member under Articles 6 and 8 above
                      (ii) exceeding the limits established in Article 4.3.3, or
                      (iii) Go2To having reasonable grounds to believe that such action is necessary to protect its security and integrity, those of its members, third parties, or for the purpose of preventing or investigating fraud<\/p>

                      Go2To reserves the right to:<\/p>

                      (i) immediately and without prior notice terminate these Terms and Conditions; and\/or
                      (ii) prevent or delete the posting of reviews, ads, messages, content, or booking requests on the platform; and\/or
                      (iii) restrict access to and use of the platform; and\/or
                      (iv) temporarily or permanently suspend your account.<\/p>

                      If applicable, you will be informed of the measures taken so that you may provide explanations to Go2To. Go2To will decide, at its discretion, whether to lift or maintain the imposed measures.<\/p>

                      1. Personal Data<\/strong><\/li><\/ol>

                        In connection with your use of the platform, Go2To will collect and process certain personal data about you.
                        By using the platform and registering as a member, you acknowledge and accept the processing of your personal data by Go2To in accordance with applicable legislation and the provisions of the Privacy Policy.<\/p>

                        1. Intellectual Property<\/strong><\/li><\/ol>

                          11.1. Content Published by Go2To<\/strong><\/p>

                          Subject to the content provided by its members, Go2To is the sole owner of all intellectual property rights related to the service, the platform, its content (including texts, images, designs, logos, videos, sounds, data, and graphics), as well as the software and databases ensuring its operation.<\/p>

                          Go2To grants you a non-exclusive, personal, and non-transferable right to use the platform and services for your personal and private use, for non-commercial purposes, and in accordance with the purpose of the platform and its services.<\/p>

                          Without Go2To\u2019s prior written consent, any other use or exploitation of the platform, services, or their content is prohibited.\nIn particular, you may not:<\/p>

                          (i) reproduce, modify, adapt, distribute, publicly display, or broadcast the platform, services, or content except as expressly permitted by Go2To;
                          (ii) decompile or reverse-engineer the platform or services, except as permitted by applicable law;
                          (iii) extract or attempt to extract (especially through data scraping or similar collection tools) a substantial portion of the platform\u2019s data.<\/p>

                          11.2. Content Published by You on the Platform<\/strong><\/p>

                          To enable the provision of services and in accordance with the purpose of the platform, you grant Go2To a non-exclusive license to use the content and data you provide when using the services (\u201cyour member content\u201d).<\/p>

                          To allow Go2To to distribute such content across digital networks and via any communication protocol (including the internet and mobile networks) and to make it publicly available, you authorize Go2To, worldwide and for the entire duration of your contractual relationship, to reproduce, display, adapt, and translate your member content as follows:<\/p>

                          (i) You authorize Go2To to reproduce your member content, in whole or in part, on any known or future digital medium, including servers, hard drives, memory cards, or equivalent storage media, in any format and by any known or future process, to the extent necessary for storage, backup, transmission, or download operations related to the operation of the platform and service provision;<\/p>

                          (ii) You authorize Go2To to adapt and translate your member content and reproduce such adaptations on any current or future digital medium, as stated in (i), for service provision, including in multiple languages.\nThis right includes the ability to modify the format of your member content, while respecting your moral rights, to comply with the platform\u2019s layout and\/or ensure technical compatibility with publication on the platform.<\/p>

                          1. Go2To\u2019s Role<\/strong><\/li><\/ol>

                            The platform is an online network through which members can create and publish ridesharing ads to share trips.<\/p>

                            These ads can be viewed by other members to learn about trip conditions and, if desired, to book a seat in the corresponding vehicle from the member who posted the ad.<\/p>

                            By using the platform and accepting these Terms and Conditions, you acknowledge that Go2To is not a party to any<\/strong> agreement between you and other members regarding cost-sharing for a trip, nor to any agreement between you and a bus operator.<\/p>

                            Go2To has no control over the behavior of its members, bus transport companies, their representatives, or platform users.<\/p>

                            It does not own, operate, supply, or manage the vehicles listed in ads, nor does it itself offer trips via the platform.<\/p>

                            You acknowledge and agree that Go2To does not verify the validity, accuracy, or legality of the ads, seats, or trips offered.<\/p>

                            As an intermediary, Go2To cannot be held liable for the actual execution of a trip or bus ride, particularly for:<\/p>

                            (i) inaccurate information provided by the driver or bus operator in the ad or elsewhere regarding the trip and its conditions;
                            (ii) the cancellation or modification of a trip by a member or company;
                            (iii) the behavior of members before, during, or after the trip.<\/p>

                            1. Operation, Availability, and Features of the Platform<\/strong><\/li><\/ol>

                              Go2To strives to keep the platform accessible 24 hours a day, 7 days a week.\nHowever, access may be temporarily suspended without prior notice for technical maintenance, migration, updates, or due to malfunctions or network limitations.<\/p>

                              Go2To also reserves the right, at its sole discretion, to modify or temporarily or permanently suspend access to the platform or certain features.<\/p>

                              1. Modification of the Terms and Conditions<\/strong><\/li><\/ol>

                                These Terms and Conditions and the documents expressly referred to herein constitute the entire agreement between you and Go2To regarding the use of the services.<\/p>

                                Any other documents or references on the platform (FAQs, etc.) are for informational purposes only.<\/p>

                                Go2To may modify these Terms and Conditions to adapt them to technological or commercial developments or to comply with new legal regulations.\nIn the event of such modification, you will be informed by e-mail at least 14 days before the changes take effect.<\/p>

                                The modifications will take effect unless you expressly object in writing within the period specified in the notification email (at least 14 days).\nYou will be informed again about this period and the consequences of not objecting.<\/p>

                                1. Governing Law \u2013 Disputes<\/strong><\/li><\/ol>

                                  These Terms and Conditions are written in Romanian and governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).<\/p>

                                  You may also submit any complaints regarding our platform or services through the online dispute resolution platform provided by the European Commission, available here.<\/p>

                                  We are neither obliged nor, in principle, willing to participate in dispute resolution proceedings before a consumer arbitration board.<\/p>
