Erivan Impex has developed a ride-sharing platform, accessible on a website at the address www.Go2To.de or in the form of a mobile application, which (i) is designed to bring drivers to a specific destination in contact with passengers going to the travel in the same direction to enable them to share the journey and therefore the costs involved, and (ii) to book tickets for bus travel operated by Go2To authorized bus companies (hereinafter referred to as “Platform" to be carried out ").
The purpose of these general terms and conditions is to regulate access and the conditions of use of the platform. Please read them carefully. You understand and acknowledge that Go2To is not a party to any agreement, contract or contractual relationship of any kind entered into between members of its platform or with any bus company.
By clicking "Login with Facebook" or "Register with an email address" you acknowledge that you have read and accepted all of these general terms of use.
If you use your account to log in to another country's Go2To platform (e.g. www.Go2To.fr; www.Go2To.it; www.Go2To.ru), please note that (i) the Terms and conditions of that platform (ii) the privacy policy of that platform and (iii) the legal rules and regulations of that country apply. This also means that information from your account, including personal data, may need to be transferred to the legal entity that operates that other platform. Please note that Go2To reserves the right to limit access to the Platform to Users who can reasonably be determined to be outside the territory of the European Union.
In this document,
„Terms and Conditions“ means these Terms and Conditions;
„Advertisement“ means an advertisement about a trip posted by a driver on the platform;
„Order“ means the process by which the Customer books its Services with Go2To Bus, whatever the means used, with the sole exception of purchasing Tickets directly at a point of sale, and which entails the obligation for the Passenger or possibly an Agent to payment of the price for the relevant services;
„Go2To" has the meaning set out in Article 1 above;
„Booking“ has the meaning set out in Article 4.2.1. under;
„Booking confirmation“ has the meaning given in Article 4.2.1 below;
„Bus operator“ refers to a company that professionally carries passengers and has been authorized by Go2To to advertise and sell its tickets on the platform;
„Bus ride“ means the journey that is the subject of a bus advertisement on the Platform and for which the bus operator proposes seats in the bus vehicles in exchange for the price;
„Bus advertising“ means an advertisement for a bus trip published by a bus company on the Platform;
„Services“ means all services provided by Go2To through the Platform;
„Facebook account“ has the meaning given in Article 3.2 below;
„Driver“ means the Member using the Platform to offer to transport another person for a fee, for one trip and at a time determined solely by the Driver;
„Carpool ride“ means the Journey that is the subject of a Carpool Advertisement published by a Driver on the Platform and for which he agrees to carry Passengers in return for the Contribution to the Cost;
„Drive“ refers indiscriminately to a bus ride or a carpool ride;
„Customer“ means any natural person (Member or not) who buys a Bus Ticket through the Platform, either for himself or on behalf of another person who will be the Passenger, in order to realize a trip operated by the Bus Company;
„Account“ means the account that must be created in order to become a Member and access certain Services offered by the Platform;
„Cost contribution“ means, for a particular carpool trip, the amount of money requested by the driver and accepted by the passenger for their contribution to the travel expenses;
„Place“ has the meaning given in Article 4.1 below;
„Carpool ad“ means an advertisement for a trip posted by a driver on the platform;
„Member“ means any person who has created an Account on the Platform;
„Member content“ has the meaning given to it in Article 11.2 below;
„Passenger“ means the Member who has accepted the offer to be carried by the Driver or, as the case may be, the person on whose behalf a Member has booked a Seat;
„Platform" has the meaning set out in Article 1 above;
„Price“ refers to the price for a specific bus trip, including all taxes, fees and costs for relevant services, paid by the Customer on the Platform at the time of confirming the order for a seat on a specific bus trip;
„Seat“ means the seat booked by a passenger in the driver's vehicle or in the vehicle operated by the bus company;
„Ticket“ means the notional valid transport title given to the consumer after booking a bus journey as proof of the existing contract of carriage between the passengers and the bus company, which is subject to the terms and conditions of sale, without prejudice to any additionally specified special conditions between the passenger and the bus company and on stated on the ticket;
„Transportation services“ refers to the transportation services subscribed to by a bus passenger and provided by the bus company;
„Point of sale“ refers to the physical counters and terminals listed on the Website where the Tickets are offered for sale;
„Conditions of Sale“ means the general terms and conditions of sale of the coach company concerned, depending on the coach trip selected by the customer, and the particular terms and conditions available on the website and accepted as having been read by the customer before placing the order;
„Site“ means the website accessible at the address www.Go2To.de.
3.1. Registration conditions on the platform
The platform may be used by persons over the age of 18. Registration on the platform by minors is strictly prohibited. By accessing, using or registering on the Platform, you represent and warrant that you are at least 18 years of age.
3.2. Creation of an account
The platform allows members to post and view ridesharing ads and interact with each other to book a seat. You can see the ads if you are not registered on the platform. However, you cannot place a carpool ad or book a seat without first creating an account and becoming a member.
To create your account you can:
(i) either complete all mandatory fields on the registration form;
(ii) or log in to your Facebook account (hereinafter referred to as your "Facebook Account") via our Platform. By using these features, you agree that Go2To will access your Facebook account, post on the Platform and retain certain information from your Facebook account. You can remove the association between your account and your Facebook account at any time through the "Verifications" section of your profile. If you want to learn more about how your data from your Facebook account is used, read our privacy policy and that of Facebook.
In order to register on the platform, you must have read and accepted these T&Cs and the Privacy Policy.
When creating your account, whichever method you choose, you agree to provide accurate and truthful information and to update it through your profile or by notification from Go2To to ensure its relevance and accuracy throughout your contractual relationship with Go2To.
In the case of registering by email, you agree to keep the password you chose when creating your account secret and not to share it with anyone. If you lose or disclose your password, you agree to notify Go2To immediately. You are solely responsible for any third-party use of your account, unless you have expressly notified Go2To of the loss, fraudulent use by a third party, or disclosure of your password to a third party.
You agree not to create or use any accounts other than those originally created under your own identity or that of a third party.
3.3. Examination
Go2To may set up a system to verify some of the information you provide in your profile for the purposes of transparency, improving trust, or preventing or detecting fraud. This is particularly the case when you enter your telephone number or send us an identification document.
You acknowledge and accept that any reference on the Platform or Services to "verified" information or similar terms only means that a Member has successfully passed the verification process in place on the Platform or Services in order to provide you with further information about the member you wish to travel with. Go2To cannot guarantee the truthfulness, reliability or validity of the information that is the subject of the verification process.
4.1. Serving ads
As a member, provided that you meet the conditions below, you can create and publish rideshare advertisements on the platform by entering information about the ride you wish to take (dates/times and collection points and arrival, number of seats offered, available options, amount of the cost contribution, etc.).
When you submit your rideshare listing, you can specify the milestone cities where you agree to stop, pick up, or drop off passengers. The portions of the ride between those Milestone Cities, or between any of those Milestone Cities, and the ride's collection point or destination constitute "Legs."
You are only eligible to place an ad if you meet all of the following conditions:
(i) You hold a valid driver's license;
(ii) You only offer carpooling advertisements for vehicles that you own or use with the express permission of the owner and in all cases that you are authorized to use for the purpose of carpooling;
(iii) You are and will remain the primary driver of the vehicle that is the subject of the complaint;
(iv) the vehicle has valid third party insurance;
(v) You have no contraindication or medical disability to drive;
(vi) The vehicle you intend to use for the trip is a 4-wheel touring car with a maximum of 7 seats, excluding cars that do not require a driver's license;
(vii) You do not intend to post another advertisement for the same ride on the Platform;
(viii) You do not offer more seating than is available in your vehicle;
(ix) all seats offered have a seat belt, even if the vehicle is approved with seats without seat belts;
(x) to use a vehicle in perfect condition, which complies with the applicable legal provisions and customs, in particular with a current TÜV certificate;
(xi) You are a consumer and not acting as a trader.
You acknowledge that you are solely responsible for the content of any rideshare advertisement that you post on the Platform. Consequently, you represent and warrant the accuracy and truthfulness of all information contained in your ride-sharing advertisement, and you agree to conduct the ride-sharing trip under the conditions described in your ride-sharing advertisement.
Your rideshare advert will be published on the platform and will therefore be visible to members and all visitors, including non-members, who conduct a search on the platform or Go2To partner websites. Go2To reserves the right, in its sole discretion and without notice, not to post or remove any rideshare advertisement that does not comply with the Terms of Service or that it deems to be detrimental to its image, that of the Platform or that of the Services.
You are informed that if, by using the Platform, you pretend to be a consumer, when in fact you are acting as a professional, you will be subject to sanctions provided for by applicable law.
4.2. Reserve a seat
Go2To has set up a system for booking seats online (“Booking”) for rides offered on the Platform.
The methods of booking a seat depend on the type of trip planned.
Go2To provides users with a search engine on the platform based on various search criteria (origin, destination, dates, number of travelers, etc.). Certain additional functionalities are provided on the search engine when the user is connected to their account. Go2To invites the user, whatever the booking method used, to carefully consult and use the search engine to identify the offer that best suits his needs. The customer booking a bus ride at a point of sale can also ask the bus operator or counter clerk to do the search.
4.2.1 Carpooling
If a passenger is interested in a rideshare ad that will benefit from booking, they can submit an online booking request. This booking request will be either (i) automatically accepted (if the driver selected this option when placing his ad) or (ii) manually accepted by the driver. At the time of booking, the passenger makes the online payment of the cost contribution. Upon receipt of payment by BlabBlaCar and, where applicable, validation of the booking request by the driver, the passenger will receive a booking confirmation (the "Booking Confirmation"). If the driver has opted to receive the cost contribution via online payment (see 5.4.1), the booking confirmation will only be sent after Go2To has received the cost contribution.
If you are a driver and have chosen to manually process booking requests when posting your rideshare ad, you must respond to each booking request within the timeframe specified by the passenger during the booking request. Otherwise, the booking request will automatically expire and the passenger will be refunded any amounts paid at the time of the booking request, if applicable.
At the time of booking confirmation, Go2To will send you the phone number of the driver (if you are the passenger) or co-driver (if you are the driver) if the member has consented to their phone number being displayed. You are then solely responsible for performing the contract that binds you to the other member.
4.2.2 Bus ride
For bus trips, Go2To allows the booking of bus tickets for a specific bus trip through the platform.
The transport services are subject to the terms and conditions of sale of the respective bus company, depending on the journey chosen by the customer, which must be accepted by the customer before the order is placed. Go2To does not provide transport services related to bus travel, the bus companies are the sole party to the Terms of Sale. You acknowledge that the booking of seats for a particular bus journey is subject to the terms and conditions of sale of the relevant bus company.
Go2To draws your attention to the fact that certain transport services offered by the bus company and mentioned on the website may be suspended, in particular for climatic reasons, seasonal reasons or in the event of force majeure
4.2.3 Nominative Character of Seat Reservation and Terms of Use of the Services on behalf of a Third Party
Any use of the Services, whether as a passenger or as a driver, is personal. Both the driver and passenger must match the identity provided to Go2To and, where applicable, to the other members participating in the carpool trip or the bus company.
However, Go2To allows its members to reserve one or more seats on behalf of a third party. In this case, you undertake to provide the driver or the bus company with the exact first name, age and telephone number of the person on whose behalf you are booking a seat at the time of booking. It is strictly forbidden to reserve a seat for a minor under the age of 13 traveling alone for a carpool ride. In the event that you reserve a seat on a carpool ride for a minor over the age of 13 traveling alone, you agree to obtain the prior consent of the driver and to provide him/her with a duly completed and signed authorization from the legal representatives. With regard to a bus trip, we invite you to read the terms and conditions of the relevant bus company.
In addition, the platform is intended for booking seats for natural persons. It is therefore forbidden to reserve a seat for the transport of objects, packages, animals traveling alone or other material objects.
In addition, posting a rideshare advertisement for a driver other than yourself is prohibited.
4.3. Rating System
4.3.1. Functionality
Go2To encourages you to leave a review about a driver (if you are a passenger) or a passenger (if you are a driver) that you have shared a ride with or should share a ride with. On the other hand, you are not eligible to post a review for another passenger if you were a passenger yourself, or for a member that you did not travel with or should not travel with.
Your rating and, if applicable, the rating left about you by another member will only be visible and published on the platform after the shorter of the following time periods: (i) immediately after you both have left a message or (ii) 14 days after the first notification .
You have the option to reply to a review that another member has left on your profile. The rating and your response, if any, will be published on your profile.
4.3.2. Moderation
You acknowledge and accept that Go2To reserves the right not to post or to delete any opinion, question, comment or answer that Go2To deems content to be inconsistent with these Terms.
4.3.3. Border
Go2To reserves the right to suspend your account, limit your access to the Services or terminate these Terms of Service if (i) you have received at least three reviews and (ii) the average of the reviews received is equal to or lower than 3.
Access to and registration on the platform, as well as research, consultation and publication of advertisements are free. On the other hand, the reservation is payable according to the conditions described below.
5.1. Contribution and price
5.1.1. As part of a carpool trip, the amount of the cost contribution is determined by you as the driver at your own risk. It is strictly forbidden to take advantage of the use of our platform. Consequently, you undertake to limit the amount of the cost contribution that you require from your passengers to the costs that you actually bear for the implementation of the carpool trip. Otherwise, you alone bear the risk of re-qualification of the transaction conducted through the platform.
When publishing a ride-sharing advertisement, Go2To proposes a cost contribution that takes into account in particular the type of ride and the distance travelled. This amount is just a guide and it's up to you to change it up or down to reflect the cost you actually pay for the ride. In order to avoid misuse, Go2To restricts the options for adjusting the amount of the cost contribution.
5.1.2. For bus trips, the price per seat is determined by the bus company at its own discretion. The customer is asked to refer to the relevant T&Cs to find out how to place the order and pay for the ticket.
5.2. Rounding
You acknowledge and agree that Go2To, in its sole discretion, may round up or down the cost contribution.
5.3 Terms of payment and repayment of the cost contribution to the driver or the fare to the bus company
As the driver, you have two options for having your passengers pay the contribution to the costs of your trip: you can choose to pay online (see 5.4.1) or pay in cash in the car (see 5.4.2).
5.3.1 Online Payment/Collection Mandate
If you decide to pay online, you give Go2To a collection order for the cost contribution in your name and on your account.
Consequently, Go2To collects the entire amount paid by the passenger (cost contributions) as part of a ride-sharing opportunity and after manual or automatic acceptance of the booking.
The cost contributions received from Go2To are deposited into an account dedicated to paying drivers.
You acknowledge and accept that none of the amounts received by Go2To in the name and on behalf of the Driver shall give rise to any interest. You agree to respond diligently to any request from Go2To and more generally from administrative or judicial authorities competent in particular to prevent or combat money laundering. In particular, you agree to provide any useful proof of address and/or identity upon simple request.
In the absence of a response to such requests, Go2To may take any action it deems appropriate, including but not limited to freezing the amounts paid and/or suspending your account and/or terminating these T&Cs.
5.3.2 Payment of the cost contribution to the driver
After the carpool trip, passengers have 24 hours to claim the trip on Go2To. If the passenger does not make a claim within this period, Go2To will consider the trip as confirmed.
From the moment of this express or tacit confirmation, you as a driver have a credit on your account. This credit corresponds to the total amount paid by the passenger at the time of booking confirmation, i.e. H. the cost contribution paid by the passenger.
If the carpool ride is confirmed by the passenger, you as the driver have the option to give Go2To instructions to transfer the money to your bank account (by entering your bank details into your account beforehand) or your PayPal account (by entering your PayPal email -Enter address in your account in advance).
The payment order on your behalf will be sent on the first working day after your request or, if you do not wish this, within 15 days after providing the relevant funds in your profile (provided Go2To has your bank details).
After the expiration of the applicable statute of limitations, any amount not claimed by Go2To shall be deemed the property of Go2To.
5.3.3 Payment in the car
If the driver decides to pay cash in the car, you, as a passenger, undertake to pay the cost contribution in cash to the driver at the latest at the collection point.
The driver may not request payment of all or part of the cost contribution before the start of the journey.
5.4 Payment of the Prize
Payment for each order placed through the Platform will be made in one of the ways authorized below. The customer has the option of saving the information on one or more credit cards in his customer account so that he does not have to systematically enter this information for subsequent payments.
The means of payment may vary depending on the Go2To platform used. The authorized means of payment are as follows:
-Credit card
-Paypal
-Coupons
- Immediately Klarna
No order confirmation will be issued before full and effective payment of the price of the transport services selected by the customer. If the payment is irregular, incomplete or not made for a reason for which the customer is responsible, the order will be canceled immediately.
The order is confirmed by sending an email to the customer containing the details of the order.
The passenger is asked to check the inbox settings of his email address and in particular to ensure that the confirmation email is not sent directly to spam.
The order confirmation is final. Consequently, any changes will result in either an exchange or cancellation under the terms of the applicable T&Cs. It is the customer's responsibility to ensure that the transportation services are selected according to the passenger's needs and expectations. The accuracy of the personal data entered by the customer is the responsibility of the latter, unless Go2To has demonstrably failed to collect, store or protect such personal data.
You agree that you will only use the Services and Platform to engage on a non-business and non-commercial basis with individuals who wish to share a ride with you or book a seat on a bus trip.
In connection with ridesharing, you acknowledge that consumer rights under Union consumer protection law do not apply to your relationship with other members.
As a driver, you agree not to charge more than the costs that you actually incur and that can generate a profit, with the proviso that you as a driver must bear your own share of the costs incurred as part of a cost sharing through the rideshare. You are solely responsible for calculating the cost you incur for the ride and verifying that the amount requested from your passengers does not exceed the actual cost you incur (excluding your share of the cost), with particular reference to the applicable tax rate.
Go2To reserves the right to suspend your account if you are using a chauffeured or other company vehicle or taxi or company car and thereby make a profit on the Platform. You agree to provide Go2To, upon simple request, with a copy of your vehicle registration document and/or any other document proving that you are authorized to use that vehicle on the Platform and are not deriving any profit from it.
Go2To also reserves the right to suspend your account, limit your access to the Services or terminate these Terms and Conditions if you engage in activities on the Platform that arise due to the nature of the rides offered, their frequency or the number of passengers carried out and the requested cost contribution results in a win-win situation for you or causes Go2To to believe for any reason that you are making a profit on the Platform.
7.1 Refund policy in case of cancellation
Trips where the driver has elected to receive the cost contribution in cash in the car can be canceled by the driver or passenger at any time prior to departure. In this case, the passenger does not pay and the driver does not receive a contribution to the costs.
Only carpool trips where the driver has opted to receive the cost contribution via online payment are subject to this cancellation policy; Go2To offers no guarantees in the event of cancellation for any reason. In connection with bus trips, the terms and conditions of sale of the bus company apply to the cancellation conditions. The customer is asked to refer to the respective conditions of sale in order to accept the conditions of exchange and cancellation of his bus trip.
Cancellation of a seat on a rideshare by the driver or passenger after booking confirmation is subject to the following provisions:
– In case of cancellation by the driver, the passenger will be refunded the entire amount paid (i.e. the cost contribution). This is particularly the case if the driver cancels a carpool trip or does not arrive at the meeting point 15 minutes after the agreed time;
-In case of cancellation by the passenger:
If the passenger cancels more than 24 hours before the scheduled departure time, as stated in the advertisement, the passenger will only be reimbursed for the cost contribution;
If the passenger cancels 24 hours or less before the scheduled departure time as stated in the advertisement and more than 30 minutes after the booking confirmation, the passenger will be refunded half of the contribution paid at the time of booking and the driver will receive 50% of the contribution;
If the passenger cancels 24 hours or less before the scheduled departure time as shown in the rideshare advertisement and 30 minutes or less after the booking confirmation, the passenger will be refunded the full cost contribution;
If the passenger cancels after the scheduled departure time stated in the advertisement or if he/she does not arrive at the meeting point 15 minutes after the agreed time, the driver will receive the cost contribution.
If a cancellation is made prior to departure and at the expense of the passenger, the seats canceled by the passenger will automatically be made available to other passengers who can book them online and will accordingly be subject to the terms of these GTC.
Go2To, in its sole discretion, will recognize the legitimacy of the refund requests based on the information available.
7.2 Right of Withdrawal
By accepting these GTC, you expressly accept that the contract between you and Go2To, which consists in the connection with another member, is to be executed before the expiry of the cancellation period since the booking confirmation and expressly waive your right of cancellation according to §356 (4 ) of the Civil Code (BGB).
8.1. Obligation of all users of the platform
You acknowledge that you are solely responsible for complying with all laws, regulations and obligations that apply to your use of the Platform.
In addition, when using the Platform and during travel, you agree to:
(i) Not to use the Platform for professional, commercial or for-profit purposes if you are not a bus company;
(ii) Not to send false, misleading, malicious or fraudulent information to Go2To (including but not limited to when creating or updating your account) or the other Members;
(iii) not to speak or behave in any way or post content on the Platform that is defamatory, hurtful, obscene, pornographic, vulgar, abusive, aggressive, inappropriate, violent, threatening, harassing, racist or xenophobic, or containing sexual Connotations, incitement to violence, discrimination or hatred, promoting activities or the use of illegal substances or more generally contrary to the purposes of the Platform, which may violate the rights of Go2To or a third party or offend against good decency;
(iv) not to infringe the rights and image of Go2To, in particular its intellectual property rights;
(v) not to open more than one account on the Platform and not to open an account on behalf of a third party;
(vi) attempting to circumvent the Platform's online booking system, in particular by attempting to send your contact details to another Member or bus company in order to make the booking outside of the Platform;
(vii) not to contact any other Member, including but not limited to through the Platform, for any purpose other than determining the terms of the ride-sharing arrangement;
(viii) not to accept or make any payments outside of the Platform, except in the cases permitted by these T&Cs;
(ix) comply with these Terms and the Privacy Policy;
(x) to obtain Go2To's permission before intending to make commercial audio or video recordings of any ride.
8.2. Driver obligations
If you use the platform as a driver, you also agree to:
(i) comply with all laws, regulations and codes applicable to driving and the Vehicle, including but not limited to having third party insurance in effect at the time of the ride and possession of a valid driver's license;
(ii) to verify that your insurance covers ridesharing and that your passengers in your vehicle are considered third parties and are therefore covered by your insurance throughout the journey;
(iii) not to take any risks when driving or to carry any product that may affect your alertness and your ability to drive alert and in absolute safety;
(iv) to post ride-sharing advertisements that match only actual scheduled trips;
(v) carry out the car pool trip as described in the advertisement (in particular with regard to the use or non-use of the motorway) and to comply with the times and places agreed with the other members (in particular the meeting point and drop-off point);
(vi) not to carry more Passengers than the number of seats specified in the Carpool Advertisement;
(vii) to use a vehicle in perfect condition, which complies with the applicable legal provisions and customs, in particular with a current TÜV certificate;
(viii) to provide Go2To or any Passenger who requests it with your driving license, car registration certificate, insurance certificate, MOT certificate and any documents proving your ability to use the Vehicle as a driver on the Platform;
(ix) promptly notify your passengers in the event of a delay or change in time or carpool travel;
(x) in the case of an international carpool trip, keep and make available to the passenger and any authority that may request, all documents proving your identity and your right to cross the border;
(xi) wait for passengers at least 15 minutes after the agreed time at the agreed meeting point;
(xii) post a ride-sharing advertisement in relation to a vehicle that you do not own or are not authorized to use for ride-sharing purposes;
(xiii) to ensure that you can be contacted by your passengers by telephone at the number registered in your profile;
(xiv) not generate any profit through the Platform;
(xv) have no contraindication or medical disability to drive;
(xvi) behave appropriately and responsibly during the ride and abide by the spirit of the ride.
8.3 Passenger Obligations
8.3.1 For ridesharing
If you are using the Platform as a rideshare passenger, you agree to:
(i) behave appropriately while carpooling so as not to disturb the concentration or driving of the driver or the tranquility of other passengers;
(ii) respect the driver's vehicle and its cleanliness;
(iii) immediately inform the driver in the event of a traffic jam;
(iv) pay the driver the agreed cost contribution;
(v) wait for the driver at the meeting point for at least 15 minutes beyond the agreed time;
(vi) to Go2To or any driver who asks to provide your ID card or a document proving your identity;
(vii) not to carry any objects, goods, substances or animals during a car pool trip which could impair the driving and concentration of the driver or which are of a type, possession or transport contrary to the applicable legal provisions;
(viii) in the case of a cross-border ride-sharing arrangement, keep and make available to the driver and any authority that may request, all documents proving your identity and your right to cross the border;
(ix) to ensure that you can be contacted by your driver by telephone on the number registered in your profile, including at the meeting point.
In the event that you have made a booking for one or more seats on behalf of a third party, in accordance with the provisions of article 4.2.3 above, you guarantee compliance with the provisions of this article and of those third parties in general by these third party GTC. Go2To reserves the right to suspend your account, limit your access to the Services or terminate these T&Cs in the event of any breach by any third party on whose behalf you have booked a seat under these T&Cs.
8.3.2 For bus travel
In connection with the bus ride, the passenger undertakes to comply with the terms and conditions of sale of the respective bus company.
You can terminate your contractual relationship with Go2To at any time free of charge and without giving reasons. To do this, simply go to the "Close My Account" tab on your profile page.
In the event of (i) your breach of these T&Cs, including but not limited to your obligations as a Member under Articles 6 and 8 above, (ii) exceeding the limit set out in Article 4.3.3 above, or (iii) if Go2To has serious cause believes that doing so is necessary to protect its safety and integrity, that of Members or third parties, or for fraud prevention or investigation purposes, Go2To reserves the right to:
(i) immediately and without notice to terminate the GTC binding you with Go2To; and or
(ii) prevent or remove the posting of reviews, advertisements, messages, content, booking requests or content posted by you on the Platform; and or
(iii) limit your access to and use of the Platform; and or
(iv) temporarily or permanently suspend your account.
If this is necessary, you will be informed of the establishment of such measures so that you can provide explanations to Go2To. Go2To, in its sole discretion, will decide whether or not to overturn the action taken.
In connection with your use of the platform, Go2To will collect and process some of your personal data. By using the Platform and registering as a member, you acknowledge and accept the processing of your personal data by Go2To in accordance with applicable law and the provisions of the Privacy Policy.
11.1 Content published by Go2To
Subject to the content provided by its members, Go2To is the sole owner of all intellectual property rights related to the service, the platform, its content (in particular text, images, designs, logos, videos, sounds, data, graphics) and the software and databases, that ensure their operation.
Go2To grants you a non-exclusive, personal and non-transferable right to use the Platform and the Services for your personal and private use, on a non-commercial basis and in accordance with the purposes of the Platform and the Services.
You are prohibited from any other use or exploitation of the Platform and the Services and their Content without the prior written permission of Go2To. In particular, you are prohibited from:
(i) Reproduce, modify, adapt, distribute, publicly display and disseminate the Platform, the Services and the Content, except as expressly authorized by Go2To;
(ii) decompile and reverse engineer the Platform or Services, subject to the exceptions set forth in the applicable texts;
(iii) Extract or attempt to extract (particularly using data mining robots or other similar data collection tools) any substantial part of the Platform's data.
11.2 Content posted by you on the Platform
To enable the provision of the Services and in accordance with the purpose of the Platform, you grant Go2To a non-exclusive license to use the content and data you provide as part of your use of the Services (collectively, “your “Member Content”). In order to allow Go2To to broadcast over the digital network and in accordance with any communication protocol (in particular Internet and mobile network) and to make the content of the platform available to the public, you authorize Go2To for the whole world and for the entire duration of your contractual relationships with Go2To to reproduce, display, adapt and translate your Member Content as follows:
(i) You authorize Go2To to reproduce all or part of your Member Content on any digital recording media, known or not yet known, including but not limited to servers, hard drives, memory cards or other equivalent media, in any format and by any process known or not yet known, to the extent necessary for Storage, backup, transmission or download operations are necessary in connection with the operation of the platform and the provision of the service;
(ii) You authorize Go2To to adapt and translate your Member Content and to reproduce such adaptations on any current or future digital media as specified in item (i) above in order to provide the Services, particularly in different languages. This right includes in particular the possibility to make changes to the formatting of your Member Content, respecting your moral rights, in order to respect the Graphic Charter of the Platform and/or to make it technically compatible with a view to its publication on the Platform.
The platform is an online network platform on which members can create and post ride-sharing advertisements for ride-sharing purposes. In particular, these ride-sharing advertisements can be viewed by the other members in order to find out the conditions of the journey and, if necessary, to book a seat in the vehicle concerned directly with the member who published the advertisement on the platform. The platform also allows booking seats for bus trips.
By using the Platform and accepting these T&Cs, you acknowledge that Go2To is not a party to any agreement between you and the other Members regarding the sharing of costs related to a ride, nor any agreement entered into between you and any Bus Operator.
Go2To has no control over the behavior of its members, bus companies and their agents, or users of the platform. It does not own, exploit, deliver or manage the vehicles that are the subject of the advertisements or offer rides on the platform.
You acknowledge and accept that Go2To does not control the validity, truthfulness or legality of the advertisements, seating and rides offered. As a ride-sharing agent, Go2To does not provide any transportation services and does not act as a carrier; Go2To's role is limited to facilitating access to the platform.
In connection with ridesharing, members (drivers or passengers) act under their sole and full responsibility.
In its capacity as an intermediary, Go2To cannot be held liable for the actual occurrence of a ride or bus ride, particularly for the following reasons:
(i) incorrect information provided by the driver or the bus operator in his advertisement or otherwise in relation to the trip and its conditions;
(ii) cancellation or modification of a trip by a Member or bus operator;
(iii) the behavior of its members during, before or after the trip.
Go2To strives to keep the platform accessible 7 days a week, 24 hours a day whenever possible. However, access to the platform may be temporarily suspended without notice due to technical maintenance, migration or update operations, or due to outages or limitations related to the operation of the network.
In addition, Go2To reserves the right, at its sole discretion, to modify or suspend access to all or any part of the Platform or its features, temporarily or permanently.
These TOS and the documents incorporated by reference express the entire agreement between you and Go2To with respect to your use of the Services. All other documents and mentions on the platform (FAQ etc.) are for guidance only.
Go2To may change these T&Cs to adapt them to their technological or commercial environment or to comply with new legislation. If such a change is required, we will notify you by email at least 14 days before the changes take effect. The changes will come into effect if you do not expressly object in text form within the period specified in the notification email (at least 14 days). We will inform you again about this period and the consequences of your objection.
These terms and conditions are written in German and are subject to German law to the exclusion of the UN Sales Convention.
You may also be able to raise your complaints in relation to our platform or our services on the online dispute resolution platform provided by the European Commission, which can be found here. We are not obliged and fundamentally unwilling to participate in a dispute settlement procedure before a consumer arbitration board.

The purpose of these general terms and conditions is to regulate access and the conditions of use of the platform. Please read them carefully. You understand and acknowledge that Go2To is not a party to any agreement, contract or contractual relationship of any kind entered into between members of its platform or with any bus company.
By clicking "Login with Facebook" or "Register with an email address" you acknowledge that you have read and accepted all of these general terms of use.
If you use your account to log in to another country's Go2To platform (e.g. www.Go2To.fr; www.Go2To.it; www.Go2To.ru), please note that (i) the Terms and conditions of that platform (ii) the privacy policy of that platform and (iii) the legal rules and regulations of that country apply. This also means that information from your account, including personal data, may need to be transferred to the legal entity that operates that other platform. Please note that Go2To reserves the right to limit access to the Platform to Users who can reasonably be determined to be outside the territory of the European Union.
In this document,
„Terms and Conditions“ means these Terms and Conditions;
„Advertisement“ means an advertisement about a trip posted by a driver on the platform;
„Order“ means the process by which the Customer books its Services with Go2To Bus, whatever the means used, with the sole exception of purchasing Tickets directly at a point of sale, and which entails the obligation for the Passenger or possibly an Agent to payment of the price for the relevant services;
„Go2To" has the meaning set out in Article 1 above;
„Booking“ has the meaning set out in Article 4.2.1. under;
„Booking confirmation“ has the meaning given in Article 4.2.1 below;
„Bus operator“ refers to a company that professionally carries passengers and has been authorized by Go2To to advertise and sell its tickets on the platform;
„Bus ride“ means the journey that is the subject of a bus advertisement on the Platform and for which the bus operator proposes seats in the bus vehicles in exchange for the price;
„Bus advertising“ means an advertisement for a bus trip published by a bus company on the Platform;
„Services“ means all services provided by Go2To through the Platform;
„Facebook account“ has the meaning given in Article 3.2 below;
„Driver“ means the Member using the Platform to offer to transport another person for a fee, for one trip and at a time determined solely by the Driver;
„Carpool ride“ means the Journey that is the subject of a Carpool Advertisement published by a Driver on the Platform and for which he agrees to carry Passengers in return for the Contribution to the Cost;
„Drive“ refers indiscriminately to a bus ride or a carpool ride;
„Customer“ means any natural person (Member or not) who buys a Bus Ticket through the Platform, either for himself or on behalf of another person who will be the Passenger, in order to realize a trip operated by the Bus Company;
„Account“ means the account that must be created in order to become a Member and access certain Services offered by the Platform;
„Cost contribution“ means, for a particular carpool trip, the amount of money requested by the driver and accepted by the passenger for their contribution to the travel expenses;
„Place“ has the meaning given in Article 4.1 below;
„Carpool ad“ means an advertisement for a trip posted by a driver on the platform;
„Member“ means any person who has created an Account on the Platform;
„Member content“ has the meaning given to it in Article 11.2 below;
„Passenger“ means the Member who has accepted the offer to be carried by the Driver or, as the case may be, the person on whose behalf a Member has booked a Seat;
„Platform" has the meaning set out in Article 1 above;
„Price“ refers to the price for a specific bus trip, including all taxes, fees and costs for relevant services, paid by the Customer on the Platform at the time of confirming the order for a seat on a specific bus trip;
„Seat“ means the seat booked by a passenger in the driver's vehicle or in the vehicle operated by the bus company;
„Ticket“ means the notional valid transport title given to the consumer after booking a bus journey as proof of the existing contract of carriage between the passengers and the bus company, which is subject to the terms and conditions of sale, without prejudice to any additionally specified special conditions between the passenger and the bus company and on stated on the ticket;
„Transportation services“ refers to the transportation services subscribed to by a bus passenger and provided by the bus company;
„Point of sale“ refers to the physical counters and terminals listed on the Website where the Tickets are offered for sale;
„Conditions of Sale“ means the general terms and conditions of sale of the coach company concerned, depending on the coach trip selected by the customer, and the particular terms and conditions available on the website and accepted as having been read by the customer before placing the order;
„Site“ means the website accessible at the address www.Go2To.de.
3.1. Registration conditions on the platform
The platform may be used by persons over the age of 18. Registration on the platform by minors is strictly prohibited. By accessing, using or registering on the Platform, you represent and warrant that you are at least 18 years of age.
3.2. Creation of an account
The platform allows members to post and view ridesharing ads and interact with each other to book a seat. You can see the ads if you are not registered on the platform. However, you cannot place a carpool ad or book a seat without first creating an account and becoming a member.
To create your account you can:
(i) either complete all mandatory fields on the registration form;
(ii) or log in to your Facebook account (hereinafter referred to as your "Facebook Account") via our Platform. By using these features, you agree that Go2To will access your Facebook account, post on the Platform and retain certain information from your Facebook account. You can remove the association between your account and your Facebook account at any time through the "Verifications" section of your profile. If you want to learn more about how your data from your Facebook account is used, read our privacy policy and that of Facebook.
In order to register on the platform, you must have read and accepted these T&Cs and the Privacy Policy.
When creating your account, whichever method you choose, you agree to provide accurate and truthful information and to update it through your profile or by notification from Go2To to ensure its relevance and accuracy throughout your contractual relationship with Go2To.
In the case of registering by email, you agree to keep the password you chose when creating your account secret and not to share it with anyone. If you lose or disclose your password, you agree to notify Go2To immediately. You are solely responsible for any third-party use of your account, unless you have expressly notified Go2To of the loss, fraudulent use by a third party, or disclosure of your password to a third party.
You agree not to create or use any accounts other than those originally created under your own identity or that of a third party.
3.3. Examination
Go2To may set up a system to verify some of the information you provide in your profile for the purposes of transparency, improving trust, or preventing or detecting fraud. This is particularly the case when you enter your telephone number or send us an identification document.
You acknowledge and accept that any reference on the Platform or Services to "verified" information or similar terms only means that a Member has successfully passed the verification process in place on the Platform or Services in order to provide you with further information about the member you wish to travel with. Go2To cannot guarantee the truthfulness, reliability or validity of the information that is the subject of the verification process.
4.1. Serving ads
As a member, provided that you meet the conditions below, you can create and publish rideshare advertisements on the platform by entering information about the ride you wish to take (dates/times and collection points and arrival, number of seats offered, available options, amount of the cost contribution, etc.).
When you submit your rideshare listing, you can specify the milestone cities where you agree to stop, pick up, or drop off passengers. The portions of the ride between those Milestone Cities, or between any of those Milestone Cities, and the ride's collection point or destination constitute "Legs."
You are only eligible to place an ad if you meet all of the following conditions:
(i) You hold a valid driver's license;
(ii) You only offer carpooling advertisements for vehicles that you own or use with the express permission of the owner and in all cases that you are authorized to use for the purpose of carpooling;
(iii) You are and will remain the primary driver of the vehicle that is the subject of the complaint;
(iv) the vehicle has valid third party insurance;
(v) You have no contraindication or medical disability to drive;
(vi) The vehicle you intend to use for the trip is a 4-wheel touring car with a maximum of 7 seats, excluding cars that do not require a driver's license;
(vii) You do not intend to post another advertisement for the same ride on the Platform;
(viii) You do not offer more seating than is available in your vehicle;
(ix) all seats offered have a seat belt, even if the vehicle is approved with seats without seat belts;
(x) to use a vehicle in perfect condition, which complies with the applicable legal provisions and customs, in particular with a current TÜV certificate;
(xi) You are a consumer and not acting as a trader.
You acknowledge that you are solely responsible for the content of any rideshare advertisement that you post on the Platform. Consequently, you represent and warrant the accuracy and truthfulness of all information contained in your ride-sharing advertisement, and you agree to conduct the ride-sharing trip under the conditions described in your ride-sharing advertisement.
Your rideshare advert will be published on the platform and will therefore be visible to members and all visitors, including non-members, who conduct a search on the platform or Go2To partner websites. Go2To reserves the right, in its sole discretion and without notice, not to post or remove any rideshare advertisement that does not comply with the Terms of Service or that it deems to be detrimental to its image, that of the Platform or that of the Services.
You are informed that if, by using the Platform, you pretend to be a consumer, when in fact you are acting as a professional, you will be subject to sanctions provided for by applicable law.
4.2. Reserve a seat
Go2To has set up a system for booking seats online (“Booking”) for rides offered on the Platform.
The methods of booking a seat depend on the type of trip planned.
Go2To provides users with a search engine on the platform based on various search criteria (origin, destination, dates, number of travelers, etc.). Certain additional functionalities are provided on the search engine when the user is connected to their account. Go2To invites the user, whatever the booking method used, to carefully consult and use the search engine to identify the offer that best suits his needs. The customer booking a bus ride at a point of sale can also ask the bus operator or counter clerk to do the search.
4.2.1 Carpooling
If a passenger is interested in a rideshare ad that will benefit from booking, they can submit an online booking request. This booking request will be either (i) automatically accepted (if the driver selected this option when placing his ad) or (ii) manually accepted by the driver. At the time of booking, the passenger makes the online payment of the cost contribution. Upon receipt of payment by BlabBlaCar and, where applicable, validation of the booking request by the driver, the passenger will receive a booking confirmation (the "Booking Confirmation"). If the driver has opted to receive the cost contribution via online payment (see 5.4.1), the booking confirmation will only be sent after Go2To has received the cost contribution.
If you are a driver and have chosen to manually process booking requests when posting your rideshare ad, you must respond to each booking request within the timeframe specified by the passenger during the booking request. Otherwise, the booking request will automatically expire and the passenger will be refunded any amounts paid at the time of the booking request, if applicable.
At the time of booking confirmation, Go2To will send you the phone number of the driver (if you are the passenger) or co-driver (if you are the driver) if the member has consented to their phone number being displayed. You are then solely responsible for performing the contract that binds you to the other member.
4.2.2 Bus ride
For bus trips, Go2To allows the booking of bus tickets for a specific bus trip through the platform.
The transport services are subject to the terms and conditions of sale of the respective bus company, depending on the journey chosen by the customer, which must be accepted by the customer before the order is placed. Go2To does not provide transport services related to bus travel, the bus companies are the sole party to the Terms of Sale. You acknowledge that the booking of seats for a particular bus journey is subject to the terms and conditions of sale of the relevant bus company.
Go2To draws your attention to the fact that certain transport services offered by the bus company and mentioned on the website may be suspended, in particular for climatic reasons, seasonal reasons or in the event of force majeure
4.2.3 Nominative Character of Seat Reservation and Terms of Use of the Services on behalf of a Third Party
Any use of the Services, whether as a passenger or as a driver, is personal. Both the driver and passenger must match the identity provided to Go2To and, where applicable, to the other members participating in the carpool trip or the bus company.
However, Go2To allows its members to reserve one or more seats on behalf of a third party. In this case, you undertake to provide the driver or the bus company with the exact first name, age and telephone number of the person on whose behalf you are booking a seat at the time of booking. It is strictly forbidden to reserve a seat for a minor under the age of 13 traveling alone for a carpool ride. In the event that you reserve a seat on a carpool ride for a minor over the age of 13 traveling alone, you agree to obtain the prior consent of the driver and to provide him/her with a duly completed and signed authorization from the legal representatives. With regard to a bus trip, we invite you to read the terms and conditions of the relevant bus company.
In addition, the platform is intended for booking seats for natural persons. It is therefore forbidden to reserve a seat for the transport of objects, packages, animals traveling alone or other material objects.
In addition, posting a rideshare advertisement for a driver other than yourself is prohibited.
4.3. Rating System
4.3.1. Functionality
Go2To encourages you to leave a review about a driver (if you are a passenger) or a passenger (if you are a driver) that you have shared a ride with or should share a ride with. On the other hand, you are not eligible to post a review for another passenger if you were a passenger yourself, or for a member that you did not travel with or should not travel with.
Your rating and, if applicable, the rating left about you by another member will only be visible and published on the platform after the shorter of the following time periods: (i) immediately after you both have left a message or (ii) 14 days after the first notification .
You have the option to reply to a review that another member has left on your profile. The rating and your response, if any, will be published on your profile.
4.3.2. Moderation
You acknowledge and accept that Go2To reserves the right not to post or to delete any opinion, question, comment or answer that Go2To deems content to be inconsistent with these Terms.
4.3.3. Border
Go2To reserves the right to suspend your account, limit your access to the Services or terminate these Terms of Service if (i) you have received at least three reviews and (ii) the average of the reviews received is equal to or lower than 3.
Access to and registration on the platform, as well as research, consultation and publication of advertisements are free. On the other hand, the reservation is payable according to the conditions described below.
5.1. Contribution and price
5.1.1. As part of a carpool trip, the amount of the cost contribution is determined by you as the driver at your own risk. It is strictly forbidden to take advantage of the use of our platform. Consequently, you undertake to limit the amount of the cost contribution that you require from your passengers to the costs that you actually bear for the implementation of the carpool trip. Otherwise, you alone bear the risk of re-qualification of the transaction conducted through the platform.
When publishing a ride-sharing advertisement, Go2To proposes a cost contribution that takes into account in particular the type of ride and the distance travelled. This amount is just a guide and it's up to you to change it up or down to reflect the cost you actually pay for the ride. In order to avoid misuse, Go2To restricts the options for adjusting the amount of the cost contribution.
5.1.2. For bus trips, the price per seat is determined by the bus company at its own discretion. The customer is asked to refer to the relevant T&Cs to find out how to place the order and pay for the ticket.
5.2. Rounding
You acknowledge and agree that Go2To, in its sole discretion, may round up or down the cost contribution.
5.3 Terms of payment and repayment of the cost contribution to the driver or the fare to the bus company
As the driver, you have two options for having your passengers pay the contribution to the costs of your trip: you can choose to pay online (see 5.4.1) or pay in cash in the car (see 5.4.2).
5.3.1 Online Payment/Collection Mandate
If you decide to pay online, you give Go2To a collection order for the cost contribution in your name and on your account.
Consequently, Go2To collects the entire amount paid by the passenger (cost contributions) as part of a ride-sharing opportunity and after manual or automatic acceptance of the booking.
The cost contributions received from Go2To are deposited into an account dedicated to paying drivers.
You acknowledge and accept that none of the amounts received by Go2To in the name and on behalf of the Driver shall give rise to any interest. You agree to respond diligently to any request from Go2To and more generally from administrative or judicial authorities competent in particular to prevent or combat money laundering. In particular, you agree to provide any useful proof of address and/or identity upon simple request.
In the absence of a response to such requests, Go2To may take any action it deems appropriate, including but not limited to freezing the amounts paid and/or suspending your account and/or terminating these T&Cs.
5.3.2 Payment of the cost contribution to the driver
After the carpool trip, passengers have 24 hours to claim the trip on Go2To. If the passenger does not make a claim within this period, Go2To will consider the trip as confirmed.
From the moment of this express or tacit confirmation, you as a driver have a credit on your account. This credit corresponds to the total amount paid by the passenger at the time of booking confirmation, i.e. H. the cost contribution paid by the passenger.
If the carpool ride is confirmed by the passenger, you as the driver have the option to give Go2To instructions to transfer the money to your bank account (by entering your bank details into your account beforehand) or your PayPal account (by entering your PayPal email -Enter address in your account in advance).
The payment order on your behalf will be sent on the first working day after your request or, if you do not wish this, within 15 days after providing the relevant funds in your profile (provided Go2To has your bank details).
After the expiration of the applicable statute of limitations, any amount not claimed by Go2To shall be deemed the property of Go2To.
5.3.3 Payment in the car
If the driver decides to pay cash in the car, you, as a passenger, undertake to pay the cost contribution in cash to the driver at the latest at the collection point.
The driver may not request payment of all or part of the cost contribution before the start of the journey.
5.4 Payment of the Prize
Payment for each order placed through the Platform will be made in one of the ways authorized below. The customer has the option of saving the information on one or more credit cards in his customer account so that he does not have to systematically enter this information for subsequent payments.
The means of payment may vary depending on the Go2To platform used. The authorized means of payment are as follows:
-Credit card
-Paypal
-Coupons
- Immediately Klarna
No order confirmation will be issued before full and effective payment of the price of the transport services selected by the customer. If the payment is irregular, incomplete or not made for a reason for which the customer is responsible, the order will be canceled immediately.
The order is confirmed by sending an email to the customer containing the details of the order.
The passenger is asked to check the inbox settings of his email address and in particular to ensure that the confirmation email is not sent directly to spam.
The order confirmation is final. Consequently, any changes will result in either an exchange or cancellation under the terms of the applicable T&Cs. It is the customer's responsibility to ensure that the transportation services are selected according to the passenger's needs and expectations. The accuracy of the personal data entered by the customer is the responsibility of the latter, unless Go2To has demonstrably failed to collect, store or protect such personal data.
You agree that you will only use the Services and Platform to engage on a non-business and non-commercial basis with individuals who wish to share a ride with you or book a seat on a bus trip.
In connection with ridesharing, you acknowledge that consumer rights under Union consumer protection law do not apply to your relationship with other members.
As a driver, you agree not to charge more than the costs that you actually incur and that can generate a profit, with the proviso that you as a driver must bear your own share of the costs incurred as part of a cost sharing through the rideshare. You are solely responsible for calculating the cost you incur for the ride and verifying that the amount requested from your passengers does not exceed the actual cost you incur (excluding your share of the cost), with particular reference to the applicable tax rate.
Go2To reserves the right to suspend your account if you are using a chauffeured or other company vehicle or taxi or company car and thereby make a profit on the Platform. You agree to provide Go2To, upon simple request, with a copy of your vehicle registration document and/or any other document proving that you are authorized to use that vehicle on the Platform and are not deriving any profit from it.
Go2To also reserves the right to suspend your account, limit your access to the Services or terminate these Terms and Conditions if you engage in activities on the Platform that arise due to the nature of the rides offered, their frequency or the number of passengers carried out and the requested cost contribution results in a win-win situation for you or causes Go2To to believe for any reason that you are making a profit on the Platform.
7.1 Refund policy in case of cancellation
Trips where the driver has elected to receive the cost contribution in cash in the car can be canceled by the driver or passenger at any time prior to departure. In this case, the passenger does not pay and the driver does not receive a contribution to the costs.
Only carpool trips where the driver has opted to receive the cost contribution via online payment are subject to this cancellation policy; Go2To offers no guarantees in the event of cancellation for any reason. In connection with bus trips, the terms and conditions of sale of the bus company apply to the cancellation conditions. The customer is asked to refer to the respective conditions of sale in order to accept the conditions of exchange and cancellation of his bus trip.
Cancellation of a seat on a rideshare by the driver or passenger after booking confirmation is subject to the following provisions:
– In case of cancellation by the driver, the passenger will be refunded the entire amount paid (i.e. the cost contribution). This is particularly the case if the driver cancels a carpool trip or does not arrive at the meeting point 15 minutes after the agreed time;
-In case of cancellation by the passenger:
If the passenger cancels more than 24 hours before the scheduled departure time, as stated in the advertisement, the passenger will only be reimbursed for the cost contribution;
If the passenger cancels 24 hours or less before the scheduled departure time as stated in the advertisement and more than 30 minutes after the booking confirmation, the passenger will be refunded half of the contribution paid at the time of booking and the driver will receive 50% of the contribution;
If the passenger cancels 24 hours or less before the scheduled departure time as shown in the rideshare advertisement and 30 minutes or less after the booking confirmation, the passenger will be refunded the full cost contribution;
If the passenger cancels after the scheduled departure time stated in the advertisement or if he/she does not arrive at the meeting point 15 minutes after the agreed time, the driver will receive the cost contribution.
If a cancellation is made prior to departure and at the expense of the passenger, the seats canceled by the passenger will automatically be made available to other passengers who can book them online and will accordingly be subject to the terms of these GTC.
Go2To, in its sole discretion, will recognize the legitimacy of the refund requests based on the information available.
7.2 Right of Withdrawal
By accepting these GTC, you expressly accept that the contract between you and Go2To, which consists in the connection with another member, is to be executed before the expiry of the cancellation period since the booking confirmation and expressly waive your right of cancellation according to §356 (4 ) of the Civil Code (BGB).
8.1. Obligation of all users of the platform
You acknowledge that you are solely responsible for complying with all laws, regulations and obligations that apply to your use of the Platform.
In addition, when using the Platform and during travel, you agree to:
(i) Not to use the Platform for professional, commercial or for-profit purposes if you are not a bus company;
(ii) Not to send false, misleading, malicious or fraudulent information to Go2To (including but not limited to when creating or updating your account) or the other Members;
(iii) not to speak or behave in any way or post content on the Platform that is defamatory, hurtful, obscene, pornographic, vulgar, abusive, aggressive, inappropriate, violent, threatening, harassing, racist or xenophobic, or containing sexual Connotations, incitement to violence, discrimination or hatred, promoting activities or the use of illegal substances or more generally contrary to the purposes of the Platform, which may violate the rights of Go2To or a third party or offend against good decency;
(iv) not to infringe the rights and image of Go2To, in particular its intellectual property rights;
(v) not to open more than one account on the Platform and not to open an account on behalf of a third party;
(vi) attempting to circumvent the Platform's online booking system, in particular by attempting to send your contact details to another Member or bus company in order to make the booking outside of the Platform;
(vii) not to contact any other Member, including but not limited to through the Platform, for any purpose other than determining the terms of the ride-sharing arrangement;
(viii) not to accept or make any payments outside of the Platform, except in the cases permitted by these T&Cs;
(ix) comply with these Terms and the Privacy Policy;
(x) to obtain Go2To's permission before intending to make commercial audio or video recordings of any ride.
8.2. Driver obligations
If you use the platform as a driver, you also agree to:
(i) comply with all laws, regulations and codes applicable to driving and the Vehicle, including but not limited to having third party insurance in effect at the time of the ride and possession of a valid driver's license;
(ii) to verify that your insurance covers ridesharing and that your passengers in your vehicle are considered third parties and are therefore covered by your insurance throughout the journey;
(iii) not to take any risks when driving or to carry any product that may affect your alertness and your ability to drive alert and in absolute safety;
(iv) to post ride-sharing advertisements that match only actual scheduled trips;
(v) carry out the car pool trip as described in the advertisement (in particular with regard to the use or non-use of the motorway) and to comply with the times and places agreed with the other members (in particular the meeting point and drop-off point);
(vi) not to carry more Passengers than the number of seats specified in the Carpool Advertisement;
(vii) to use a vehicle in perfect condition, which complies with the applicable legal provisions and customs, in particular with a current TÜV certificate;
(viii) to provide Go2To or any Passenger who requests it with your driving license, car registration certificate, insurance certificate, MOT certificate and any documents proving your ability to use the Vehicle as a driver on the Platform;
(ix) promptly notify your passengers in the event of a delay or change in time or carpool travel;
(x) in the case of an international carpool trip, keep and make available to the passenger and any authority that may request, all documents proving your identity and your right to cross the border;
(xi) wait for passengers at least 15 minutes after the agreed time at the agreed meeting point;
(xii) post a ride-sharing advertisement in relation to a vehicle that you do not own or are not authorized to use for ride-sharing purposes;
(xiii) to ensure that you can be contacted by your passengers by telephone at the number registered in your profile;
(xiv) not generate any profit through the Platform;
(xv) have no contraindication or medical disability to drive;
(xvi) behave appropriately and responsibly during the ride and abide by the spirit of the ride.
8.3 Passenger Obligations
8.3.1 For ridesharing
If you are using the Platform as a rideshare passenger, you agree to:
(i) behave appropriately while carpooling so as not to disturb the concentration or driving of the driver or the tranquility of other passengers;
(ii) respect the driver's vehicle and its cleanliness;
(iii) immediately inform the driver in the event of a traffic jam;
(iv) pay the driver the agreed cost contribution;
(v) wait for the driver at the meeting point for at least 15 minutes beyond the agreed time;
(vi) to Go2To or any driver who asks to provide your ID card or a document proving your identity;
(vii) not to carry any objects, goods, substances or animals during a car pool trip which could impair the driving and concentration of the driver or which are of a type, possession or transport contrary to the applicable legal provisions;
(viii) in the case of a cross-border ride-sharing arrangement, keep and make available to the driver and any authority that may request, all documents proving your identity and your right to cross the border;
(ix) to ensure that you can be contacted by your driver by telephone on the number registered in your profile, including at the meeting point.
In the event that you have made a booking for one or more seats on behalf of a third party, in accordance with the provisions of article 4.2.3 above, you guarantee compliance with the provisions of this article and of those third parties in general by these third party GTC. Go2To reserves the right to suspend your account, limit your access to the Services or terminate these T&Cs in the event of any breach by any third party on whose behalf you have booked a seat under these T&Cs.
8.3.2 For bus travel
In connection with the bus ride, the passenger undertakes to comply with the terms and conditions of sale of the respective bus company.
You can terminate your contractual relationship with Go2To at any time free of charge and without giving reasons. To do this, simply go to the "Close My Account" tab on your profile page.
In the event of (i) your breach of these T&Cs, including but not limited to your obligations as a Member under Articles 6 and 8 above, (ii) exceeding the limit set out in Article 4.3.3 above, or (iii) if Go2To has serious cause believes that doing so is necessary to protect its safety and integrity, that of Members or third parties, or for fraud prevention or investigation purposes, Go2To reserves the right to:
(i) immediately and without notice to terminate the GTC binding you with Go2To; and or
(ii) prevent or remove the posting of reviews, advertisements, messages, content, booking requests or content posted by you on the Platform; and or
(iii) limit your access to and use of the Platform; and or
(iv) temporarily or permanently suspend your account.
If this is necessary, you will be informed of the establishment of such measures so that you can provide explanations to Go2To. Go2To, in its sole discretion, will decide whether or not to overturn the action taken.
In connection with your use of the platform, Go2To will collect and process some of your personal data. By using the Platform and registering as a member, you acknowledge and accept the processing of your personal data by Go2To in accordance with applicable law and the provisions of the Privacy Policy.
11.1 Content published by Go2To
Subject to the content provided by its members, Go2To is the sole owner of all intellectual property rights related to the service, the platform, its content (in particular text, images, designs, logos, videos, sounds, data, graphics) and the software and databases, that ensure their operation.
Go2To grants you a non-exclusive, personal and non-transferable right to use the Platform and the Services for your personal and private use, on a non-commercial basis and in accordance with the purposes of the Platform and the Services.
You are prohibited from any other use or exploitation of the Platform and the Services and their Content without the prior written permission of Go2To. In particular, you are prohibited from:
(i) Reproduce, modify, adapt, distribute, publicly display and disseminate the Platform, the Services and the Content, except as expressly authorized by Go2To;
(ii) decompile and reverse engineer the Platform or Services, subject to the exceptions set forth in the applicable texts;
(iii) Extract or attempt to extract (particularly using data mining robots or other similar data collection tools) any substantial part of the Platform's data.
11.2 Content posted by you on the Platform
To enable the provision of the Services and in accordance with the purpose of the Platform, you grant Go2To a non-exclusive license to use the content and data you provide as part of your use of the Services (collectively, “your “Member Content”). In order to allow Go2To to broadcast over the digital network and in accordance with any communication protocol (in particular Internet and mobile network) and to make the content of the platform available to the public, you authorize Go2To for the whole world and for the entire duration of your contractual relationships with Go2To to reproduce, display, adapt and translate your Member Content as follows:
(i) You authorize Go2To to reproduce all or part of your Member Content on any digital recording media, known or not yet known, including but not limited to servers, hard drives, memory cards or other equivalent media, in any format and by any process known or not yet known, to the extent necessary for Storage, backup, transmission or download operations are necessary in connection with the operation of the platform and the provision of the service;
(ii) You authorize Go2To to adapt and translate your Member Content and to reproduce such adaptations on any current or future digital media as specified in item (i) above in order to provide the Services, particularly in different languages. This right includes in particular the possibility to make changes to the formatting of your Member Content, respecting your moral rights, in order to respect the Graphic Charter of the Platform and/or to make it technically compatible with a view to its publication on the Platform.
The platform is an online network platform on which members can create and post ride-sharing advertisements for ride-sharing purposes. In particular, these ride-sharing advertisements can be viewed by the other members in order to find out the conditions of the journey and, if necessary, to book a seat in the vehicle concerned directly with the member who published the advertisement on the platform. The platform also allows booking seats for bus trips.
By using the Platform and accepting these T&Cs, you acknowledge that Go2To is not a party to any agreement between you and the other Members regarding the sharing of costs related to a ride, nor any agreement entered into between you and any Bus Operator.
Go2To has no control over the behavior of its members, bus companies and their agents, or users of the platform. It does not own, exploit, deliver or manage the vehicles that are the subject of the advertisements or offer rides on the platform.
You acknowledge and accept that Go2To does not control the validity, truthfulness or legality of the advertisements, seating and rides offered. As a ride-sharing agent, Go2To does not provide any transportation services and does not act as a carrier; Go2To's role is limited to facilitating access to the platform.
In connection with ridesharing, members (drivers or passengers) act under their sole and full responsibility.
In its capacity as an intermediary, Go2To cannot be held liable for the actual occurrence of a ride or bus ride, particularly for the following reasons:
(i) incorrect information provided by the driver or the bus operator in his advertisement or otherwise in relation to the trip and its conditions;
(ii) cancellation or modification of a trip by a Member or bus operator;
(iii) the behavior of its members during, before or after the trip.
Go2To strives to keep the platform accessible 7 days a week, 24 hours a day whenever possible. However, access to the platform may be temporarily suspended without notice due to technical maintenance, migration or update operations, or due to outages or limitations related to the operation of the network.
In addition, Go2To reserves the right, at its sole discretion, to modify or suspend access to all or any part of the Platform or its features, temporarily or permanently.
These TOS and the documents incorporated by reference express the entire agreement between you and Go2To with respect to your use of the Services. All other documents and mentions on the platform (FAQ etc.) are for guidance only.
Go2To may change these T&Cs to adapt them to their technological or commercial environment or to comply with new legislation. If such a change is required, we will notify you by email at least 14 days before the changes take effect. The changes will come into effect if you do not expressly object in text form within the period specified in the notification email (at least 14 days). We will inform you again about this period and the consequences of your objection.
These terms and conditions are written in German and are subject to German law to the exclusion of the UN Sales Convention.
You may also be able to raise your complaints in relation to our platform or our services on the online dispute resolution platform provided by the European Commission, which can be found here. We are not obliged and fundamentally unwilling to participate in a dispute settlement procedure before a consumer arbitration board.
